News, Notes & Spins – September 1, 2010

Recently I received a fair warning from a friend that questions have been asked concerning my radio show, my involvement with many area radio stations, my blog, and my work in servicing Colorado music to radio and press… in other words, there are apparently some questions concerning payola as it relates to the Rocky Mountain Music Network and my radio show and review blogs.

Payola, as defined by the FCC is “…a violation of the sponsorship identification rule …in the American music industry, is the illegal practice of payment or other inducement by record companies for the broadcast of recordings on music radio, in which the song is presented as being part of the normal day’s broadcast. Under US law, 47 U.S.C. § 317, a radio station  can play a specific song in exchange for money, but this must be disclosed on the air as being sponsored airtime, and that play of the song should not be counted as a “regular airplay”. The term has come to refer to any secret payment made to cast a product in a positive light (such as obtaining positive reviews). – source http://www.answers.com/topic/payola

Section 317(a) of the Communications Act of 1934, as amended, and Section 73.1212 of the Commission’s Rules require that a sponsorship identification be given “[w]hen a broadcast station transmits any matter for which money, service, or other valuable consideration is either directly or indirectly paid or promised to, or charged or accepted by such station.

I can say I’ve never received any money, services or other valuable considerations to air anything… or to review anything positively … ever.  No promises of airplay are ever made — no promises of a review.  I sent out cds to Colorado radio and press… and in most of the cases my soliciting those cds came AFTER I had already played it and wanted to make sure the rest of the state got a copy.  If that’s payola .. well then, damn it!

However, since I do accept money for servicing and promoting Colorado music to Colorado radio and press it seems I’m walking a mighty fine line here, both with my radio program and my blog.  Yep… new rules concerning blogs that review and how reviewers are compensated (“payola”) have now also emerged.

In weighing the costs and benefits associated with this decision I have had to ask what is most important to the community I serve, as well as to my own personal gain.  It’s obvious that I cannot afford to contest this issue.  It appears obvious (today at least) that I either have to give up promoting music to radio and press, or stop doing my radio show and my record reviews here.

I make part of my income servicing/promoting Colorado records.  I make NO money from my show or my blog.   So, unless I find out otherwise – from some legitimate legal source –  it at least appears that if I promote, you won’t get to hear The Colorado Sound … and if I want to keep airing hear the show, I MAY NOT be able to promote.  Fucked up deal, ain’t it?

Station News and Notes

On July 1, 2010, KRFC Board of Directors President Jess Griess suggested an audacious idea — what if we flip KRFC to a Colorado focus radio station; could it be done?  So to not vote on emotion, the Board (I’m a Board Director) decided to table a vote until we had a chance to reflect on the potential — good and bad — of making this a permanent decision.

At the August 5th board meeting the Directors voted 5-1 to have the Interim General Manager evaluate and implement programming methodology to turn KRFC’s (sans any legitimate reason not to) programming into a format that favors a broad based regionally related focus – in music, public affairs, news and all other manner of content.

On August 25, the Board held an all-hands meeting with the volunteers and stakeholders of KRFC to present the idea and allow for public comment.  Generally speaking, with notable exceptions concerning some specialty shows, the idea was received reasonably well by those in attendance.

KAFM Executive Director Ryan Stringfellow announced his resignation effective November 2010.  That now makes two EDs that have resigned (Chris Kennison at KRFC is out as of Aug 31).  Dennis Bigelow has been appointed as the Interim General Manager at KRFC, pending a search and hire process by the Board.  Also, there has been no public announcement yet of the program director position at KSJD (Mancos/Cortez) being filled.
